Your privacy is important to Monscierge, LLC (“Company”, “we”, “our” or “us”) the entity that owns and operates the Monscierge Connect application (the “Licensed Application”). This Privacy Policy (“Policy”) explains how we collect, use and protect your personal information and under what circumstances it may be disclosed to others.
By downloading, accessing, viewing and/or using the Licensed Application and/or any Licensed Application affiliated Company websites (“Affiliated Company Sites”), you agree to be bound by the terms and conditions of this Policy, the Licensed Application End User License Agreement and all other terms and conditions set forth in the Licensed Application. If you do not agree, please do not access, view or use the Licensed Application. By accepting this Policy, you expressly grant the Company the right to use and disclose your personal information in accordance with this Policy. Please be advised that this Policy is applicable to the Licensed Application and any Affiliated Company Sites, and that the practices described in this Policy do not necessarily reflect our practices for other websites or applications we may now or in the future operate or distribute.
In order to facilitate your experience, and manage our business, we may collect and maintain certain personal information about you. The Company collects personal information from many sources to understand and meet your needs. We may collect certain information about you from:

You may also be able to submit information about other people. For example, you might submit a person’s name and e-mail address or mobile phone or other messaging number to send an electronic post card or other greeting card. The types of personally identifiable information that may be collected about other people at these pages include: recipient’s name, address, e-mail address, and telephone (and/or text, SMS or other messaging) number.
Depending on the service, you may be asked for additional information so that you may receive all of the features, functionality offerings, and benefits of the Licensed Application or so that we may otherwise service your Licensed Application account. You understand that only the persons who provide us with the requested personal information may be able to obtain products and services or otherwise participate in all of the features, functionality, offerings and benefits of the Licensed Application.
In addition to obtaining your personal information when you submit it to us, we may collect tracking information such as your Device or browser type, the type and version of operating system or software you use, the name of your internet or mobile service provider, and the pages, content and features visited when you use the Licensed Application or an Affiliated Company Site or the websites or applications of our affiliates, partners, sponsors or service providers. The Company obtains this information to improve the functionality and user-friendliness of the Licensed Application and Affiliated Company Sites and to better tailor the Licensed Application and Affiliated Company Sites to our users’ needs. In addition to the sharing and use of your information as otherwise permitted elsewhere in this Policy, we may also use this information to verify that users meet the criteria required to process the applicable requests. We may also collect it for reporting Licensed Application and Affiliated Company Site activity in the aggregate (i.e., without identifying you personally). For example, we may want to know how long the average user spends on the Licensed Application and Affiliated Company Sites our or which pages, content or features get the most attention.
To enhance your experience with the Licensed Application and Affiliated Company Sites, we may use “cookies” and/or similar technologies. Cookies are text files we place in your Device’s browser to store your preferences. Cookies, by themselves, do not tell us your e-mail address or other personal information unless you choose to provide this information to us by, for example, registering or creating an account with the Licensed Application and/or an Affiliated Company Site. However, once you choose to furnish the site with personal information, this information may be linked to the data stored in the cookie or similar technologies. In addition to the uses of this information described in this section below, we may also share or transfer this information with or to a Company affiliate or other third parties as otherwise provided for in this Policy below.
We use cookies and/or similar technologies to understand Licensed Application usage and other application and website usage and to improve the content and offerings on the Licensed Application and Affiliated Company Sites. For example, we may use cookies and/or similar technologies to personalize your experience on the Licensed Application and at Affiliated Company Sites (e.g., to recognize you by name when you return the Licensed Application and Affiliated Company Sites, and enable you to access certain Licensed Application and Affiliated Company Site features). We also may use cookies or similar technologies to offer you products, programs, or services (including by collecting information about the searches you conduct via or on the Licensed Application or Affiliated Company Sites).
We may collect IP addresses, Device identifier information, browser, software or operating system information and data, click-stream data and/or other session data for purposes of system administration, to improve the Licensed Application and Affiliated Company Sites, to report aggregate information to our advertisers and sponsors and/or other internal uses related to the Licensed Application and Affiliated Company Sites. An IP address is a number that is automatically assigned to your computer whenever you access the Internet. Our computers identify your computer by its IP address, and our computers identify your Device by its identifier. When you request pages or content from the Licensed Application and Affiliated Company Sites, our computers log your IP address and/or Device identifier.
Click-stream data is information collected by our computers when you request pages and content from the Licensed Application or Affiliated Company Sites. Click-stream data may include such information as the page served, the time, the source of the request, the type of browser making the request, the preceding page view and other such non-personal information. When analyzed, this data helps us analyze how visitors arrive at the Licensed Application and Affiliated Company Sites, what type of content is most popular, what type of visitors in the aggregate are interested in particular kinds of content and advertising, and the like.
“Web beacons” or “clear .gifs” are small pieces of code placed on a webpage or in content to monitor the behavior and collect data about the visitors viewing a webpage or certain content. For example, web beacons can be used to count the users who view a certain webpage or view certain content or to deliver a cookie or similar code to the browser or Device of a visitor viewing that page or content. We may use web beacons on the Licensed Application and Affiliated Company Sites from time to time for this and other purposes.
In addition, we may use third-party advertising technology to serve advertisements on search engines and/or when you visit or use the Licensed Application and Affiliated Company Sites and sites upon which we advertise. This technology uses information about your visits to and uses of the Licensed Application, Affiliated Company Sites and the sites upon which we advertise to serve advertisements to you. In the course of serving our advertisements, a unique third-party cookie or similar code may be placed or recognized on your browser or your Device. You may be able to disable the use of cookies and similar technologies through your web browser or your Device, but doing so may cause certain features of the Licensed Application and Affiliated Company Sites to not work properly.
We may also use web beacons and similar technologies, provided by our ad serving partner(s), to help manage our online advertising. These web beacons and technologies enable our ad server to recognize a cookie or similar code when a browser or device visits or accesses the Licensed Application and/or Affiliated Company Sites and to learn which advertisements or listings bring users to the Licensed Application and Affiliated Company Sites.
We may also use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help us analyze how the Licensed Application and Affiliated Company Sites are used. The information generated by the cookie about use of the Licensed Application and Affiliated Company Sites (including your IP address) will be transmitted to and stored by Google on servers owned by Google. Google will use this information for the purpose of evaluating use of Licensed Application and Affiliated Company Sites, compiling reports on application and website activity for application and website operators and providing other services relating to Licensed Application and Affiliated Company Site activity and internet and mobile application usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. The collected data is not tied to any single individual, no individual profiles are created, and Google will not associate your IP address with any other data held by Google.
Some web browsers may transmit “do-not-track” signals to the applications and websites with which the user communicates, although web browsers incorporate and activate this functionality in different ways, and it is not always clear whether users intend for these signals to be transmitted. Accordingly, except to the extent required by applicable law, we do not respond to these signals at this time.
We may also provide survey questionnaires and track your traffic patterns, benefit usage and preferences in a personally identifiable manner, in order to enhance your use and enjoyment of the Licensed Application and Affiliated Company Sites and better service your account, personalize your service, and develop additional benefits, content, features, offers, products and services of interest to you.
Any information gathered from click data, benefit usage, surveys, preferences, log files, cookies and other ways you interact with the Licensed Application and Affiliated Company Sites is aimed at enhancing your use and enjoyment of the Licensed Application and Affiliated Company Sites and better servicing your account, helping us develop the design and layout of the Licensed Application and Affiliated Company Sites, and determining and providing additional products, services, content, features, benefits and offers that may be of value to users of the Licensed Application. We may also share or transfer this information with or to a Company affiliate or other third parties as set forth below in this Policy.
In the course of ensuring network security and consistent service for all users, the Company employs software programs to do such things as monitor network traffic, identify unauthorized access or access to nonpublic information, detect computer viruses and other software that might damage our computers or the network, and monitor and tune the performance of the Licensed Application and Affiliated Company Sites, and our network. In the course of such monitoring, these programs may detect such information as e-mail headers, addresses from network packets, and other information. Information from these activities for the purpose of maintaining the security and performance of our the Licensed Application and your use and enjoyment of the Licensed Application and Affiliated Company Sites, and our networks and computer systems. We may also share or transfer this information with or to a Company affiliate or other third parties as set forth below in this Policy.
We recognize the importance of protecting the privacy of children, and our service is not intended for use by children. For this reason, we do not knowingly collect or maintain information from children under the age of thirteen (13). The Company also encourages parents to discuss the internet and Device applications with their children and monitor personal information that a child may provide via the internet and Device applications.
We may use the information you provide about yourself to fulfill your requests for our products, programs and services (including booking and reservation requests and orders you place), to respond to your inquiries about our offerings, and to offer you other products, advertisements, programs or services (including promotional offers, products and services of Destinations, Travel Providers and other third parties) that we believe may be of interest to you. We may also use this information and disclose it to certain Destinations and Travel Providers which have developed a specific, enhanced Licensed Application program with Monscierge (“Licensed Application Partners”) so that you may enjoy the enhanced functionality of the Licensed Application which is applicable to such Licensed Application Partners.
We sometimes use this information to communicate with you, such as to notify you when you have won one of our promotions or when we make changes to this Policy or the Licensed Application End User License Agreement or other applicable terms and conditions, to fulfill a request by you for an online newsletter, or to contact you about your account with us.
We use the information that you provide about others to enable us to send them postcards or other messages. From time to time, and subject to applicable law, we also may use this information to offer them our products, programs, or services and/or those of Destinations, Travel Providers, Licensed Application Partners, Third Party Sites or other third party which is listed on or included in, or advertises on or through, the Licensed Application (collectively, “Featured Third Parties”).
In addition, we may use data for administrative and analytic purposes, such as information systems management, accounting, billing, audits, credit card processing and verification, customer-relations correspondence, and other operation management functions with respect to the Licensed Application and Affiliated Company Websites.
The Company may also provide your personal information, including your contact information, demographic information, information regarding your use of the Licensed Application, and information concerning your use, interests and preferences (including your consumer interests and preferences, your preferences with respect to the Licensed Application and related content, products and services, location data, tracking and other aggregate information, Public Forum (defined below) information, and other information collected through surveys and/or questionnaires and/or traffic logs, security programs, cookies, web beacons, clear .gifs” and/or similar technologies), to certain Licensed Application Partners, other Featured Third Parties and other third parties for their use in connection with the Licensed Application and for their independent marketing, analytic and/or other legally permissible purposes. These third-parties may send you email, text, SMS or similar messages relating to their products and/or services or we may send an email, text, SMS or similar message on their behalf.
To the extent required or permitted by law, we may disclose your personal information to government authorities, or to third parties pursuant to a subpoena or other legal process, and we may also use or disclose your information as permitted by law to protect the rights or property of the Company and Affiliated Company Sites, and the users of the Licensed Application and Affiliated Company Sites. We also may disclose such information in response to a law enforcement agency’s request, or where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our applicable terms and conditions(including the Licensed Application End User License Agreement), or as otherwise required by law.
In addition to the above, we sometimes contract with other companies and individuals (for instance, our service providers) to perform functions on our behalf or otherwise in connection with the Licensed Application, such as hosting the Licensed Application and Affiliated Company Sites, administering and fulfilling promotions or sweepstakes, performing marketing surveys, focus groups or interviews, fulfilling and administering Licensed Application benefits (including fulfilling services and products obtained through the Licensed Application), or promoting other opportunities offered by the Licensed Application. These parties may have access to personal information, such as addresses, needed to perform their functions, but are generally restricted from using it for other purposes.
We have unique partnerships with individual supplier companies for the purpose of providing the various benefits of the Licensed Application. As such, we may be required to exchange information, which may include your e-mail address and text, SMS and other similar messaging numbers, with one or more of these suppliers in order to ensure that you are able to use the Licensed Application and related services, products, benefits, features, and content. The information exchanged is limited to what is required to meet this purpose.
As we continue to develop our business, we might sell or buy assets. In such transactions, user information generally is one of the transferred business assets. Accordingly, we may sell, transfer or assign your personal information, including your contact information, demographic information, information regarding your use of the Licensed Application, and information concerning your use, interests and preferences (including your consumer interests and preferences, your preferences with respect to the Licensed Application and related content, products and services, location data, tracking and other aggregate information, Public Forum information, and other information collected through surveys and/or questionnaires and/or traffic logs, security programs, cookies, web beacons, clear .gifs̱ and/or similar technologies) to a Company affiliate or a third party (to the extent permitted by applicable law) as part of any such transaction. Also, if the Licensed Application and any Affiliated Company Websites, or either the Company or substantially all of our assets, were acquired, your personal information may be one of the transferred assets.
The Company also uses customer information to identify, develop and market products and services that we believe you will value. From time to time, you may receive offers from us or our affiliates or from third-party companies (e.g., Licensed Application Partners) with whom we have a business relationship.
Please note that where this Policy permits us and/or our affiliates, partners and other third parties to contact you, such contact may be made by e-mail, text, SMS and/or similar method unless you unsubscribe from receiving communications via a particular method as set forth below. Remember, your wireless carrier may impose a charge on incoming texts. Please check with your wireless carrier for details.
Monscierge must periodically receive your GPS location and other location data in order to provide certain services to you (e.g., to inform you of Destinations, Travel Providers, offers and other items and Content which may be specific or relevant to your current location). By using any such location based services, you authorize Monscierge to locate your GPS hardware and your location, and to record, compile and display your location. You acknowledge that if you don’t allow us to access and use such location data (or we are otherwise unable to obtain such data), then you may not be able to make use of all of the features and benefits of the Licensed Application and/or Affiliated Company Sites, including the receipt of Destinations, Travel Providers promotional offers and other items or Content which are specific or relevant to your location.
From time-to-time, we may offer content (e.g., contests, sweepstakes, or promotions) sponsored by or co-branded with identified third parties, including certain Licensed Application Partners. By virtue of these relationships, these third parties may obtain personally identifiable information that Licensed Application and Affiliated Company Site users visitors voluntarily submit to participate in the applicable Licensed Application or Affiliated Company Site activity. We do not have ultimate control over the use of this information by such third parties or any other information provided to other third parties as permitted hereunder, and the use of this information by and communications from those third parties may be subject to the privacy policies of those third parties. We encourage you to review the applicable privacy policies of such third parties.
We may use a third party to present or serve the advertisements that you may view and the Licensed Application or Affiliated Company Sites. These third party ad servers may use cookies, web beacons, clear .gifs or similar technologies to help present such advertisements, and to help measure and research the advertisements’ effectiveness. The use of these technologies by these third party ad servers may be subject to their own privacy policies and is not covered by this Policy.
While a user of the Licensed Application, you cannot opt out of emails, text, SMS and similar messages related to, and the sharing of information with third parties which is required to enable, your use of the Licensed Application and/or Affiliated Company Sites, and/or Licensed Application and/or Affiliated Company Site benefits, features, content, services or products (including notifications to you of Destinations and Travel Providers that may be of interest to you). If you no longer wish to receive such communications and messages and/or to permit such information sharing, you must (a) contact privacy@monscierge.com, and (b) terminate your license to use the Licensed Application and remove the Licensed Application and related software and content from your Device.
We would like to keep you informed about email, text, SMS and similar communications from Licensed Application Partners, Destinations, Travel Providers and other third parties that do not relate to your use of the Licensed Application and/or Affiliated Company Sites, and/or Licensed Application and/or Affiliated Company Site benefits, features, content, services or products. If you wish to opt out of receiving these communications from us, simply follow the instructions or links contained in the communication or by contact us at privacy@monscierge.com. If you opt out of receiving these unrelated communications, please note that we will continue to send and provide you information that you may find valuable in your use of the Licensed Application and/or Affiliated Company Sites, and/or Licensed Application and/or Affiliated Company Site benefits, features, content, services or products, such as the availability of special offers and new or upgraded products, services, benefits, content and features, such as the availability of special offers and new or upgraded products, services, benefits, features and content. If you wish not to receive these unrelated communications by a particular method, please contact us at privacy@monscierge.com, and we will try to accommodate your request. If you unsubscribe from receiving messages via a particular method, we and others may continue to send you communications by other methods consistent with the terms of this Policy. Note that if you unsubscribe for a particular communication method (e.g., text, SMS), it may affect your ability to receive or take full advantage of certain Licensed Application benefits, services, features, content or products or related offers. Further note that our systems may not be able to accommodate your request to receive these unrelated communications via certain methods but not by other methods so we may have to unsubscribe you from all or other methods as well in order to honor your request.
If you participate in a Licensed Application or Affiliated Company Site message board, chat room, comment, review or other discussion forum, messaging feature, or any similar feature (collectively, “Public Forums”), you should be aware that the information you provide there will, by the very nature of the use of a Public Forum, be made publicly available to others, potentially inside and outside of the Company and its affiliates. We cannot ensure the security of any information you choose to make public on, in or via a Public Forum. Also, we cannot ensure that parties who have access to such publicly available information will respect your privacy. Please exercise caution when deciding to disclose personal information (including location data) via a Public Forum. Also, please recognize that these Public Forums may have additional rules and conditions. Each participant’s opinion expressed on, in or via a Public Forum is his or her own and should not be considered as reflecting the opinion of the Company.
The information we collect in connection with such Public Forums is used to provide an interactive experience. In addition to the sharing and use of your information as otherwise permitted elsewhere in this Policy, we may also use this information to facilitate participation in these Public Forums and, from time to time, to offer you products, features, content, benefits, programs, or services. If you choose to submit content for publication in a Public Forum (e.g., questions for an online chat guest), we may publish your screen name and other information you have provided to us (e.g., transcript of the chat, including your question), including as provided in the Licensed Application End User Agreement.
Information security is important to the Company. We maintain reasonable physical, electronic and procedural safeguards in an effort to protect personal information and we regularly review our security standards and procedures to protect against unauthorized access to personal information. We cannot guarantee the security of our database, nor can we guarantee that information you supply will not be intercepted while being transmitted to us through electronic means. We ask that you do your part by maintaining your Licensed Application and Affiliated Company Site account information (including, as applicable, passwords and access codes) strictly confidential. You should not disclose any of your passwords to third parties or write them down or store them where others may view them. If someone else knows any of your passwords, you may lose substantial control over your personal information and may be liable for legally binding actions taken in your name by the person using such passwords, including as provided in the Licensed Application End User Agreement. Therefore, if your any of your passwords have been compromised, you should immediately contact us at privacy@monscierge.com.
E-mails or messages you receive may include links that provide automatic login. If you forward those e-mails to third parties, you may be providing them access to your benefits, account information or contact information. Similarly, while we may provide the option to place a “Remember Me” cookie on your Device or machine or use another technology that allows you automatic login when using your Device or machine, you should not select that option if you are using a public or otherwise unsecured Device or machine (your local library, for instance), as this may give others using that machine access to your benefits or contact information.
This Policy is applicable to the Company, the Licensed Application, and Affiliated Company Sites. Please note that we provide additional links or other connections to affiliate, partner and third-party sites, applications and systems (e.g., booking and/or reservation systems) we think you will find useful. These links and connections will lead you to sites, applications and systems that may operate under different privacy practices and policies not under our control. The Company is not responsible for the content or privacy practices of websites, applications or systems to which we link. If you decide to access any of the third-party websites, applications or systems linked on or connected to the Licensed Application or Affiliated Company Sites, you do this entirely at your own risk. You are responsible for reviewing the privacy policies for such other web sites, applications and systems. If you cannot find the privacy policy of any of these sites via a link on the site’s homepage, you should contact the third party which provides the site, application or system directly for more information.

The Company reserves the right to change this Policy at any time with or without notice to you. You are responsible for remaining knowledgeable as to any changes made to this Policy by periodically checking the Licensed Application and Affiliated Company Sites for updated versions.
If you are accessing the Licensed Application or Affiliated Company Sites from outside of the United States, your information will be transferred to the United States. Regardless of where your information is collected or transferred, the information will be treated in accordance with this Policy.
